Who Needs a Factory License in Uttar Pradesh?

The law clearly states who must get a license. If a unit meets any of the following conditions, it must register:

  • Uses power and has 10 or more workers, or
  • Does not use power but has 20 or more workers

Both types must apply. Even seasonal factories must register if they meet this number. The license is not optional. It becomes mandatory the moment the factory meets these limits.

Also, if a factory wants to expand its capacity, change its layout, or shift its location, it must inform the Labour Department and update the license.

Documents Required for Factory License Registration

Before applying, one must prepare some documents. These papers help the Labour Department verify the setup, location, ownership, and safety standards.

  1. ID and Address Proof of the Applicant
  2. Pan Card and Aadhar Card of the Owner
  3. Ownership Proof or Rent Agreement of the Premises
  4. Site Plan or Layout Plan of the Factory (signed by a registered engineer)
  5. Details of Power Usage
  6. Particulars of Machinery Used
  7. Consent from State Pollution Control Board (if its needed)
  8. Certificate of Incorporation (for Companies or LLPs)
  9. List of Workers and Their Details
  10. NOC from Local Body or Panchayat (if needed)
  11. Challan of Fee Paid

Step-by-Step Process to Register a Factory in UP

In UP, the full application process happens online. The Labour Department uses the “Nivesh Mitra” portal, which is a single-window system for business approvals.
Here is a step-by-step guide:

Step 1: Create an Account on Nivesh Mitra

Visit the official portal niveshmitra.up.nic.in. Click on “Register Here” and fill basic details like name, mobile, and email. Verify the OTP and login to your new account

Step 2: Fill Application Form for Factory License

  1. After login, go to “Apply for Services”
  2. Choose the “Factory License” option
  3. Fill in the factory details like name, address, type of ownership, power usage, and worker strength
  4. Upload the necessary documents

Step 3: Pay the Fees

The system will generate a challan based on the number of workers and power usage. Make the payment online through the payment gateway

Step 4: Track the Application

Once submitted, you’ll receive an Application ID. You can use it to track progress on the dashboard. Authorities may ask for clarification or additional documents

Step 5: Site Inspection (if needed)

In some cases, a site inspection is conducted by a Factory Inspector. They will check layout, safety measures, emergency exits, etc. You’ll be informed in advance about the visit

Step 6: License Approval and Download

If all documents and reports are fine, the license will be approved. You’ll receive a downloadable copy from the dashboard. The license is valid for one year or as per choice at the time of application.

Renewal of Factory License

  2. Go to the license renewal section
  3. Check the pre-filled details
  4. Upload any fresh documents if needed
  5. Pay the renewal fee
  6. Submit and track the status
