The criteria for choosing the license are not only about turnover. They also involve the production capacity or the handling capacity of the business unit. 

FSSAI Basic Registration Criteria:

Turnover: Must not exceed ₹12 Lakhs per year
Production/Handling Capacity:

  • Food production (other than milk, meat): Up to 100 kg/liter per day
  • Milk procurement/handling: Up to 500 liters per day

FSSAI State License Criteria:

Turnover: Must be between ₹12 Lakhs and ₹20 Crores per year
Production/Handling Capacity:

  • Food production (excluding milk, meat): Between 101kg per liter and 2 Metric tonnes (MT) per day.
  • Milk buying/processing: 501 liters/day to 50,000 liters/day.
  • Storage Capacity: Up to 10,000 MT.
  • Hotels: Hotels of Three-Star or Four-Star.
  • Wholesalers/Retailers/Distributors: Turnover to 20 Crores (30 Crores as of some transportation/wholesale withdrawal lines).

  • Food production: Greater than 2 Metric tonnes (MT) in a day.
  • Milk buying/processing: More than 50, 000 liters daily.

  • Those FBOs with operations in two or more states.

FSSAI State License Registration in India is a detailed procedure that requires the FBO to gather substantial documentation and successfully complete an inspection by the State Food Safety Officer. The entire registration process is conducted online via the FoSCoS portal

FSSAI State License Registration Process - Step-by-Step Guide

The process is centralized. It uses the FoSCoS portal. Following these steps correctly ensures a smooth application flow.

Step 1: Pre-application Check The FBO first checks their turnover and capacity against the FSSAI criteria. They confirm the State License is the correct category. They gather all the required documents

Step 2: Online Application Submission The FBO registers on the FoSCoS portal. They select the appropriate State and District. They fill out Form B with all necessary business details, food product categories and technical information

Step 3: Document Upload and Fee Payment The FBO uploads all the scanned, mandatory documents. They pay the applicable Government Fee online. A 14-digit application reference number is generated upon successful submission. The applicant must keep this number safe

Step 4: Scrutiny by State licensing Authority The application goes into scrutiny. The form and the documents are verified by the State Licensing Authority. The time limit of this stage is official 15-30 days.

Step 5: Inspection and Query Resolution In case the application is satisfactory the authority can send a Food Safety Officer (FSO) to conduct an inspection. The FSO checks the premises, hygiene and FSMS. If the FSO identifies any problem the authority poses a question. The prospective employee should respond to the enquiry and submit the corrected documents before the end of the 30 days.

Step 6: License Grant If the inspection report is favourable and all the questions are answered, the State Licensing Authority grants the application. The FSSAI State License is obtained.

FSSAI State License Validity and Renewal Process

The FSSAI State License is not a permanent grant. It is issued for a specific period chosen by the food business operator, with a minimum validity of one year and a maximum validity of five years

FSSAI Renewal Process

The FBO must start the renewal process early. The renewal application is accepted 180 days before the license expires

  1. Initiate Renewal: The FBO logs into the FoSCoS portal. They select the license for renewal. They choose the new validity period (1 to 5 years)
  2. Update Documents: The FBO ensures all documents are current. This includes new photos, a recent Water Test Report, or an updated FSMS plan. Manufacturers must mandatorily file the Annual Return (Form D-1) for the previous financial year
  3. Pay Renewal Fee: The FBO pays the renewal fee
  4. Scrutiny and Grant: The State Licensing Authority scrutinizes the renewal application. They check for compliance issues over the last license term. They may conduct a new inspection. If approved, the license is renewed for the new period.

Penalty of Not Obtaining FSSAI License

Operating a medium-sized food business without a valid FSSAI State License is a serious violation of the Food Safety and Standards Act 2006 and can result in severe legal and financial penalties including heavy fines and potential imprisonment. The law views unlicenced operation as a threat to public health and safety. The punishment is designed to deter non-compliance effectively.

  1. Punishment of Operating Without a License: The FBO will have to bear the punishment of imprisonment up to a period of six months. One has to pay a fine of up to 5 Lakhs as well. This is a criminal offense.
  2. Penalty on Sub-Standard Food: FBO can be fined not more than 5 Lakhs in case an inspection reveals that the food quality is sub-standard. This is even in the case of a valid license.
  3. Fine on Misbranded Food: In case food is misbranded or falsely advertised the penalty will be a fine of up to 3 Lakhs.
  4. Penalty for Unhygienic Practices: If the FBO uses unhygienic or unsanitary conditions for processing or manufacturing, a fine of up to ₹1 Lakh is levied.
