Without it, many companies cannot sell or distribute their goods legally in India. Concept of Legal Metrology

Legal metrology is the law that deals with weights and measures. This law ensures that measuring tools used in trade are fair and reliable. It also covers goods that come in packages. Every package must show correct information like quantity, price, name of the product, and who packed it.

For example, a company that sells 1-liter milk packets must make sure every packet holds exactly one liter. Legal Metrology checks this. If the packet holds less, then the company may face a fine or lose their license.

The primary goal of the LMPC certificate is to protect consumers’ rights. It makes sure that customers get what they pay for. At the same time, it helps honest businesses compete fairly. If all follow the same rules, no one gets an unfair edge.

Legal Metrology or LM Act 2009

The Legal Metrology Act of 2009 is the foundation of this system in India. This law was passed to bring uniformity in weights and measures. It replaced old laws that had become outdated. The Act applies to anyone who produces, imports, sells, or uses weighing and measuring tools. It also applies to goods that are sold in packaged form.

Under this act:

  • Weight units and measurements must follow the metric system.
  • Penalties apply for false claims, short measures, or wrong labeling.
  • Packaged goods must carry proper labels with clear and correct information.
  • A legal metrology officer verifies and stamps every weighing and measuring device.

This act gives the central government the power to make rules. States also follow these rules but may have their own officers for inspections and enforcement.

Controller of Legal Metrology

The Legal Metrology Controller is the department’s head in every state. This officer supervises the legal metrology activities in the region. Their work is important for keeping trade clean and fair. They have several duties:

  • They can fine or penalize companies that break the law.
  • They approve and verify weighing and measuring instruments.
  • They train and manage field officers who do the actual inspections.
  • They check labels on packaged goods to make sure they follow the rules.
  • They also handle complaints from the public about short measures or false labels.

The controller works under the Ministry of Consumer Affairs. Their office is the place where businesses go to apply for certificates or solve legal metrology issues.

Types of Certifications Issued by Legal Metrology

Businesses that deal with weighing tools or packaged goods need one or more types of legal metrology certificates. These certificates make sure that the business is legal, the goods are accurate, and the customers are safe.

There are two main types of certifications:

A. Legal Metrology Packaged Commodity Registration

This registration is needed by any company that packs goods in advance and sells them in packets. The Legal Metrology Packaged Commodities Rules, 2011, govern it. This certificate is for:

  • Manufacturers
  • Importers
  • Packers
  • Marketers

The law says that no such company can sell packaged goods without registering. The business must register with the Director of Legal Metrology, Government of India.

This registration ensures that the packet has:

  • Product name
  • Quantity (in weight or volume)
  • Date of packing
  • Expiry date (if applicable)
  • Price (MRP)
  • Name and address of the packer
  • Customer care details

Without this registration, packaged goods cannot be sold in the market. Breaking this rule can cause up to ₹25,000 in penalty for the first offense.

B. Model Approval Certificate

Model approval is required before a business can manufacture or import any kind of weighing or measuring device. Before the device is sold or used in India, it must be tested and approved.

This rule ensures that:

  • The device gives correct readings.
  • It meets technical standards.
  • It is safe to use.

Only after passing all checks will the Director of Legal Metrology give a model approval certificate. This certificate confirms that the device model is legal for use and sale.

The government charges a small fee for issuing legal metrology certificates. The amount may differ based on the certificate type and number of products. Here is a general guide to the fee:

Application Process of Legal Metrolgy

The Legal Metrology application process can be done online using the National Single Window System (NSWS Portal).  Most applications for packaged goods registration go through the central government portal. Here’s how the process works:

1. Choose the Certificate:

  • The applicant decides the correct certificate: packaged goods, model approval, importer license, etc.

2. Prepare Documents:

  • Gather all documents as per the checklist. Ensure clarity and proper format.

3. Register on the Portal:

  • Go to the official Legal Metrology website and create a login ID.

4. Fill application form:

  • Enter business details and product info, and upload the required documents.

5. Pay the Fee:

  • Make payment using UPI, debit card, or net banking. Get a payment receipt.

6. Submit the Application:

  • After checking all fields, submit the form. Keep the application number safe.

7. Department Review:

  • The Legal Metrology office checks documents and may ask for corrections.

8. Inspection, if needed:

  • For model approval or stamping, an officer may visit the site for inspection.

9. Certificate Issued:

  • Once approved, the certificate is generated and sent by email or available for download.

Legal Metrology Packaged Commodities Rules, 2011

These rules came into force under the 2009 Act. They tell us how packaged goods must be labeled and sold in India. These rules protect customers from fraud and cheating. They also help businesses follow a single standard across the country. Key rules under this law:

  • The font size on the label must be readable.
  • Dual MRP on the same product is not allowed.
  • If its a food package, FSSAI rules must also be followed
  • The net quantity must match the contents shown on the label.
  • Every package must show MRP, product name, weight or volume, and packing date.
